By accessing or using the mobile applications, websites, or services (collectively, the "Services") provided by Snow Sand Enterprises, LLC ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Services.

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. Use of the Services

Permitted Use

You may use our Services for lawful purposes and in accordance with these Terms. You agree to use the Services only for their intended purpose and in compliance with all applicable laws and regulations.

Prohibited Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems.
• Interfere with or disrupt the integrity or performance of the Services.
• Transmit any viruses, malware, or other harmful code.
• Use the Services to harass, abuse, or harm another person.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Use automated means (bots, scrapers, etc.) to access the Services without our written permission.

3. Intellectual Property

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, software, and code), are owned by Snow Sand Enterprises, LLC and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

4. User Content

You retain ownership of any content you create, upload, or store through our Services ("User Content"). By using our Services, you grant us a limited, non-exclusive license to host, store, and process your User Content solely for the purpose of providing and improving the Services.

You are responsible for the accuracy, legality, and appropriateness of your User Content. We reserve the right to remove content that violates these Terms or applicable law.

5. Purchases & Subscriptions

Some features of our Services may be available through paid subscriptions or one-time purchases. If applicable:

• Prices are displayed in the app and are subject to change with reasonable notice.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Purchases are processed through the applicable app store (Apple App Store or Google Play Store) and are subject to their respective terms and refund policies.
• We do not process payments directly; all billing is handled by the app store platform.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Services is at your sole risk.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Snow Sand Enterprises, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services;
• Unauthorized access, use, or alteration of your data or transmissions.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts located in Texas, and you consent to the jurisdiction of such courts.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised Terms.
